Terms and Conditions of Booking

Buttercrane Travel (live2escape.com) strongly recommends you print a copy of these Terms and Conditions of Booking for future reference.

We endeavour to ensure that all our customers have complete satisfaction no matter what their requirements are. It should, however, be understood that we are acting on behalf of the supplier of the travel product specified and that all bookings are accepted on the following conditions:-

1. DEFINITIONS In these conditions:-
"package" means the prearranged combination of at least two of transport, accommodation and other tourist services not ancillary to transport or accommodation and accounting for a significant proportion of the package when sold at an inclusive price. The submission of separate accounts for different components shall not cause the arrangements to be other than a package and the fact that a combination is arranged at your request and in accordance with your specific instructions (whether modified or not) shall not of itself cause it to be treated as other than prearranged;
"travel product" means packages and any other travel related products including (without limitation) flight, rail and coach tickets and insurance;
"Operator" means any person who organizes travel products and sells them or offers them for sale through Buttercrane Travel.
Words denoting the singular include the plural.

2. LIABILITY . We act on behalf of various tour operators and companies in connection with the sale of travel products and we are an agent of the operator(s) concerned. Accordingly, there is no direct contractual relationship between you on the one hand and us on the other hand. All bookings accepted by us and arrangements made by us are subject to the terms and conditions of the operator concerned and we have no direct contractual liability to you in connection with the travel product specified except as may be imposed by law.

3. PAYMENT . A deposit is payable at the time of booking and the balance is payable in accordance with the terms and conditions of the operator concerned or (if applicable) as shown.

4. CANCELLATION . In the event that you do not pay for the travel product specified within the time limits specified by the operator concerned or (if applicable) as shown we reserve the right on our own behalf and the operator to cancel your booking of the travel product on your behalf, or not to confirm the final booking with the operator, in either case without further notification to you. If this occurs then the initial deposit will not be refundable and the balance of any further money paid by you for the travel product will be dealt with in accordance with the operator's terms and conditions and any applicable law.

5. REMINDERS . The receipt/invoice is your final account and no further reminder regarding payment will be sent.

6. ALTERATIONS
Buttercrane Travel / www.live2escape.com reserves the right to cancel or make a material alteration to a travel product:-
(i) for any reason whatsoever prior to the day on which payment of the balance of the price becomes due; or
(ii) for reasons of force majeure at any time prior to departure.
"Force majeure" means circumstances where performance and/or prompt performance of the contract is prevented by reason of war or threat of war, riots, civil strife, industrial dispute, terrorist activity, natural or nuclear disasters, fire or adverse weather conditions and other similar circumstances beyond the control of Buttercrane Travel / www.live2escape.com.

6.1 Late Arrivals / Delays
6.1.1. It is your responsibility to arrive at all departure points at the time specified in the tickets and/or itineraries supplied by Buttercrane Travel / www.live2escape.com.

6.1.2. Buttercrane Travel / www.live2escape.com does not accept responsibility for the consequences of late or non-arrival as specified above.

6.2 Passports, Visas, Health Requirements and Driving Licences
You are responsible for the provision of necessary valid documents including visas.

6.3 Insurance. We reserve the right not to accept bookings from clients who are not insured against such holiday or travel risks as we may from time to time specify.

6.4 Health. Prior to travelling abroad, you are advised to study the information given in DHSS Leaflet "Protect your Health Abroad" which is available on request.

6.5 Complaints. Any complaints in respect of the travel product specified must be made in writing within six weeks of the end of the holiday or journey concerned.

6.6 Liability
Holiday arrangements excluding packages: In consideration of the fact that the Company acts only as a booking agent, the Company has no liability whatsoever for any aspect of the arrangements and, in particular, has no liability for any loss, personal injury or death however incurred.

"Packages": If any part of the package you book with the Company is not as described and does not reach a reasonable standard, or if you suffer personal injury, illness or death as a result of any improper performance by the Company of the obligations it owes to you under this contract, the Company will pay you reasonable compensation taking into account all relevant factors including the invoice price of your package, any steps it was reasonable for you to take to minimise the inconvenience/damage suffered and the extent to which the deficiency or improper performance can have affected your enjoyment of the package. However, this acceptance of liabilities is subject to the following three qualifications :-

  • The Company will not be liable to pay you any compensation if the deficiency, personal injury, illness or death concerned does not result from any fault on the part of the Company or its suppliers, but is caused by your own acts and/or omissions, by the acts and/or omissions of a third party (excluding one of the Company's suppliers) or by circumstances which neither the Company nor its suppliers could have anticipated or avoided even exercising all due care.
  • It is a condition of the payment of compensation to you that you notify the Company of any complaint or claim and, further, assign to the Company any rights you may have against any third party in connection with your claim. You must co-operate with the Company and the Company's insurers in this regard.
  • If you suffer a personal injury, death or serious difficulties as the result of an activity which does not form part of the package you have booked with the Company, the Company will not be liable to pay you any compensation but will offer you such advice and guidance as is reasonable in all the circumstances.

Nothing in these conditions shall be deemed to exclude or restrict the Company's liability for death or personal injury caused by its negligence.
